Terms of Service

These Terms of Service (the "Terms") govern your use of Best Disc (the "Service"), operated from bestdisc.org. By accessing or using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction, whichever is higher) to use the Service. If you operate an account on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Accounts

Accounts are created via Discord OAuth. You are responsible for activity on your account and for keeping your Discord credentials secure. You may delete your account at any time from the dashboard; doing so initiates the data deletion process described in our Privacy Policy.

3. Listings and user content

You retain ownership of content you submit (server descriptions, screenshots, templates, reviews, etc.). You grant Best Disc a non-exclusive, worldwide, royalty-free license to host, display, cache, and distribute that content solely to operate the Service and promote your listing.

You represent that you have the right to submit any content you upload, and that the content does not infringe third-party rights, violate applicable law, or violate the Acceptable Use Policy.

4. Paid features

Premium subscriptions, sponsored auction placements, and other paid features are billed via Stripe. Subscriptions renew automatically until canceled. Refunds are issued at our discretion in accordance with applicable consumer protection law. Auction wins are final on settlement.

5. Moderation

We may remove, edit, or refuse any listing or user content, suspend accounts, or revoke paid placements that violate these Terms, the Acceptable Use Policy, or applicable law. We aim to give notice and a chance to appeal but reserve the right to act immediately when harm is occurring or imminent.

6. DMCA and copyright

Send takedown notices to legal@bestdisc.org with the elements required by 17 U.S.C. § 512. Counter-notices follow the same process. Repeat infringers are terminated.

7. Disclaimer

Best Disc is provided "as is" without warranties of any kind. We do not warrant that the Service will be uninterrupted, error-free, or that listing data is accurate. Listed servers and bots are operated by third parties; we are not responsible for their conduct.

8. Limitation of liability

To the maximum extent permitted by law, Best Disc and its operators are not liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of data, revenue, or profits arising from your use of the Service. Our aggregate liability for direct damages is limited to the greater of (a) the amount you paid us in the 12 months preceding the claim or (b) USD $100.

9. Discord trademark

Best Disc is an independent directory. We are not affiliated with, endorsed by, or sponsored by Discord Inc. "Discord" and related marks are property of Discord Inc.

10. Changes

We may revise these Terms; material changes will be announced via email or an in-app notice at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance.

11. Governing law

These Terms are governed by the laws of the jurisdiction in which the Service operator is organized, without regard to conflict-of-laws rules. Disputes will be resolved in the courts of that jurisdiction, subject to any mandatory consumer protection rights in your jurisdiction.
